📜 General Terms and Conditions for the Trade-In Service
§1 Scope
(1) These terms and conditions govern the trade-in service, where customers can exchange used figures for store credit.
(2) By using the trade-in service, the customer accepts these terms and conditions.
§2 Eligibility
(1) Only adults with a residence in Germany are eligible to participate.
(2) The customer assures that they are the rightful owner of the submitted goods and are authorized to sell them.
§3 Trade-In Process
(1) The customer submits details of the figures offered via the provided form or by email.
(2) Based on these details, the customer receives a non-binding preliminary offer.
(3) If the customer accepts the offer, they will receive a free shipping label for sending in the goods.
(4) Upon receipt of the goods, a quality and condition inspection will be carried out.
(5) After the inspection is completed, store credit will be issued in accordance with §6, or an adjusted offer will be made.
§4 Condition of Goods & Accuracy of Description
(1) The customer must truthfully state the condition of the figures.
(2) The submitted goods must be free of defects beyond normal signs of wear and tear, unless otherwise specified.
(3) Accessories and original packaging do not automatically increase the purchase value.
(4) The goods must be free from third-party ownership, liens, stolen property, or other third-party rights.
§5 Inspection & Offer Adjustment
(1) The operator inspects the submitted figures to the best of their knowledge and belief.
(2) If the actual condition deviates from the description, the original offer may be adjusted accordingly.
(3) The customer can accept or reject an adjusted offer within 7 days.
(4) If customers reject an adjusted offer, the goods can either:
- (a) be returned at their own expense or
- (b) be disposed of free of charge upon request.
§6 Remuneration in the Form of Store Credit
(1) The equivalent value will be remunerated exclusively in the form of store credit.
(2) Payment in cash, bank transfer, or other payment methods is excluded.
(3) The credit will be credited to the customer's account after confirmed inspection.
(4) The credit can be used to pay for items in the shop; shipping costs may be excluded.
(5) The credit is valid for 12 months from the date of credit (different regulations may apply).
§7 Transfer of Ownership
(1) Upon crediting of the store credit, ownership of the submitted figures irrevocably transfers to the operator.
(2) A revocation or withdrawal after the transfer of ownership is excluded.
§8 Shipping & Risk
(1) Shipping to the operator is done using a free shipping label.
(2) The operator bears the transport risk until delivery.
(3) For return shipping according to §5, the customer bears the shipping costs and the transport risk.
(4) In case of submission of counterfeits, replicas, or non-original goods, the customer bears all incurred costs, in particular:
- Outbound and return shipping
- Inspection and processing costs
- Disposal costs, if applicable
§9 Exclusions
Excluded from participation are:
- Counterfeits / Replicas / Bootlegs
- Goods with severe damage, missing parts, or functional defects (depending on the offer)
- Goods with odor contamination such as nicotine, mold, or animal odors
- Stolen goods or goods without clear ownership
(2) In case of suspicion of counterfeiting or criminal offense, the goods may be withheld or handed over to authorities.
(3) In cases according to §8 para. 4, no remuneration will be paid.
§10 Data Protection
(1) Personal data will only be processed for the purpose of carrying out the trade-in process.
(2) Data will only be passed on for technical and logistical processing (e.g., shipping service providers).
(3) Further information can be found in the shop's data protection policy.
§11 Liability
The operator is only liable for intent or gross negligence.
Further claims for damages are excluded, to the extent legally permissible.
§12 Final Provisions
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) Should individual clauses be ineffective, the validity of the remainder of the document remains unaffected.
